TERMS & CONDITIONS 

Introduction 

These terms and conditions ("Terms and Conditions") apply to Creek to Coast RE Investments Pty Ltd (ABN 35 660 724 229) trading as McGrath Coffs Coast Escapes. 

McGrath Coffs Coast Escapes operates as an agent managing short-term accommodation bookings on behalf of property owners ("Properties"). 

By using this website or booking with us, you ("Guest" or "you") agree to these Terms and Conditions, forming a binding agreement between you and McGrath Coffs Coast Escapes. Guests receive a temporary licence to occupy the booked Property, not a residential tenancy under any tenancy legislation. 

 

Key Disclosures 

Liability 
Under clauses 19, and 22McGrath Coffs Coast Escapes and property owners are not liable for losses except those directly caused by them and within their control. Use of this website or linked sites is also at your own risk. 

Indemnity 
As per clauses 20, you agree to indemnify McGrath Coffs Coast Escapes and property owners from claims or damages arising from your stay, except when directly caused by them. 

Referral and Incentive Arrangement 
McGrath Coffs Coast Escapes may receive commissions, fees, or financial benefits from property owners, partners, or suppliers related to bookings. 

Privacy and Data Sharing 
Under clause 28, if a Guest breaches these Terms, McGrath Coffs Coast Escapes may share relevant data with third parties. 

Compliance with State Laws and Codes of Conduct 
By booking, you agree to comply with applicable laws and codes of conduct and assist McGrath Coffs Coast Escapes and property owners in meeting their obligations. 

NEW SOUTH WALES (NSW) – Code of Conduct 

The NSW Code of Conduct for the Short-Term Rental Accommodation Industry ("Code") applies to all accommodation bookings at the Properties. It outlines the rights and responsibilities of participants, including McGrath Coffs Coast Escapes and Guests. 

You can access the Code here or visit the NSW Office of Fair Trading website to search for it or contact their office directly to request a copy. 

 

Your Obligations 

By making a booking, you confirm that you have read, understood, and agree to comply with the NSW Code of Conduct for Short-Term Rental Accommodation. 


1. General Terms 

  • Rates: Prices are per dwelling, per night, for the standard number of guests. 
  • Damage & Cleaning: Guests are responsible for damages, repairs, replacements, or excessive cleaning fees. 
  • RelocationMcGrath Coffs Coast Escapes may relocate bookings to a property of the same standard if necessary. 
  • Eligibility: Bookings require a minimum of 1 Guests to be 18+. The credit card used must match the Guest making the booking. 
  • Changes & Extensions (Booking Amendment): Subject to availability you may incur a $55 fee. 
  • Smoking is prohibited in all Properties and where strata or body corporate by-laws ban smoking. 

If smoking occurs in violation of these rules, an additional cleaning fee of $500 may apply. 

Property Damage 

We accept normal wear and tear but reserve the right to charge for damages such as: 

  • Cigarette burns or stains 
  • Broken furniture, crockery, or glass 
  • Excessive cleaning required 

Any repair costs will be deducted from the credit card on file. 

Renovations & Building Works 

McGrath Coffs Coast Escapes is not responsible for noise, disturbances, or inconvenience caused by renovations or building works outside the property, as these are beyond our control. 

No Party Policy 

We enforce a strict no-party policy.  Disturbances, including excessive noise after 10pm are not tolerated. Any violation may result in immediate cancellation of the booking. 

2. Payment Information and Guest Service Fee Inclusions 

Deposit and Balance: 

  • 25% of the total tariff is required at time of booking. 
  • The remaining balance is due 14 days before arrival or 21 days before arrival for Peak Season bookings.  

Payment Process: 

  • Deposits are secured through SecurePay or Commonwealth Bank of Australia (CBA). 
  • The saved credit card will be charged automatically when the balance is due (with a reminder email sent 7 days before). 
  • This card also serves as security during your stay (charges only applied for damages or excessive cleaning). 

Transaction Fees: 

  • All transactions incur a 3% non-refundable fee covering gateway, e-merchant, and administrative processing costs. 

Guest Service Fees: 

  • May include booking fees, linen, technology fees, online travel agent commissions, and incidental damage fees. These fees can change without notice and may be applied as flat fees, percentages, or a mix of both. 

Additional Charges: 

  • Extra services (e.g, Cot hire, highchair hire, extra linen) may incur further fees. 
Guest Responsibilities: 

      a) Key Security: Guests are liable for lost keys and replacement locks. 
      b) Additional Charges: Excess cleaning, garbage removal, or damages will be charged to the credit card on file. 


3. Check-In Times and Key Collection 

Check-In: 

  • From 2PM  
  • From 3PM during peak periods 

Check-Out: 

  • 10AM on the departure date (keys must be returned by this time). 
  • Late Check-Out Fee: $75 if not returned on time. 

After-Hours Arrivals: 

  • If you need to collect the keys for a Property directly from our office, please inform us if you plan to arrive outside of office hours so we can provide you with key collection instructions.  

4. Cancellation Policy  

Refunds & Cancellations: 
 a) Non-Refundable: Bookings made within 14 days of arrival. 
 b) Refundable (less booking fee & 3% transaction fee): Cancellations made 14 + days before arrival. 
 d) Peak Season Cancellations within 21 days of arrival are non-refundable. 


General Conditions: 

  • Shortened stays are non-refundable. 
  • Bookings via third-party platforms (e.g., Stayz, Booking.com, Airbnb) are subject to the provider’s terms and additional fees. 

Third-Party Sync Issues: 

  • Occasionally, online bookings may not sync correctly with McGrath Coffs Coast Escapes. In such cases, Guests must resolve the issue with the booking platform directly. 

5. Guest Violation Register and Schoolies/Party Bookings 

Guest Violation Register: 

  • If you or any guest breaches these Terms, your name, phone number, email, and details of the breach may be listed on a guest violation register and shared with property owners or agents. 
  • McGrath Coffs Coast Escapes reserves the right to refuse or cancel bookings for guests listed on guest violation registers. 

Strict No Party Policy: 

  • Hosting a party or overcrowding will result in immediate eviction without refund. 

Schoolies Bookings: 

  • Schoolies-related bookings will be immediately cancelled and evicted without refund, regardless of other terms and conditions. 

6. Linen 

Included: 

  • Bed linen, bath towels, blankets, doonas, and pillows are supplied unless otherwise stated. 
  • Basic items such as tea, coffee, sugar, washing powders, soap, shampoo, toilet paper, and tea towels are typically provided. 

Not Included: 

  • Toiletries (Guests must bring their own). 
  • Beach towels. 

7. Use of the Property & Eviction 

Residential Use Only: 

  • Properties are strictly for holiday accommodation. Occupants must adhere to building rules and by-laws, especially for strata or community title properties. 
  • Prohibited Uses: No functions, parties or similar gatherings are allowed. 

Consequences of Unauthorised Use: 

  • Immediate termination of the stay. 
  • Removal of all occupants by Security or Police. 
  • No refund for forfeited payments. 
  • Guest is responsible for Security, Police, and noise abatement costs. 

8. Number of Occupants and Vehicles 

Occupancy Limits: 

  • Properties accommodate a specific number of Guests. Extra mattresses, tents and the like are not allowed. 
  • Overcrowded properties will result in eviction without a refund. 

Cots for Children: Available for an additional charge upon request. 

Parking: 

  • Vehicles must be parked only in designated spaces. 
  • Nature strips or unauthorised spaces cannot be used for parking. 

9. Privately Owned Properties 

Agency Role: 

  • McGrath Coffs Coast Escapes acts as an agent on behalf of the Property owner. 
  • Instructions from the owner will be adhered to, even if McGrath Coffs Coast Escapes disagrees, provided those instructions are lawful. 

Potential Changes: 

  • Bookings may change if the Property is sold, removed from the market, or altered by the owner. 
  • No liability for changes beyond McGrath Coffs Coast Escapes. 

 10. Property Description 

Good Faith Effort: 

  • McGrath Coffs Coast Escapes strives to provide the most accurate descriptions and images possible. 
  • Minor or non-material changes (e.g., furniture rearrangements) will not result in refunds or responsibility. 

Faults and Malfunctions: 

  • No obligation to compensate or discount for minor issues with appliances or amenities. 


11. Property Tariffs 

Pricing Adjustments: 

  • Efforts are made to maintain accuracy, but McGrath Coffs Coast reserves the right to correct errors and adjust tariffs. 
  • Guests will be notified of any changes as soon as possible. 

Booking Rules: 

  • Some rates may have minimum stay requirements or require arrival on specific days. 

12. Internet, TV, Foxtel, and Streaming Services 

Service Availability: 

  • Internet is not guaranteed. Disruptions may occur due to weather or low signal strength. 
  • No liability for outages or limited service during the stay. 

13. Functions and Events Policy 

Strict No-Function Policy: 

  • No parties of any kind are permitted. 
  • Penalty Fee: Unauthorised functions will incur a $2,500 fee. 

This policy ensures compliance with community expectations and preserves the quality of residential accommodation. 

14. Inspections & Repairs 

Inspection Rights: 

  • McGrath Coffs Coast Escapes may inspect the property at any time during your stay without prior notice if a breach of the terms is suspected. 
  • Emergency Repairs: Entry may be made without notice to address urgent repairs. 
  • For non-emergency inspections, 24 hours’ notice will be given. 

15. Pets 

Pet-Friendly Properties: 

  • Pets are allowed only in specific properties. 
  • If a pet is brought into a non-pet property, the stay may be terminated without compensation. 

Additional Cleaning Costs: Any extra cleaning required due to pets will be charged to the credit card held on file within 72 hours of departure. 

16. Cleaning & Garbage 

Garbage Removal: 

  • Bins are provided at all properties. Garbage must be placed in bins and put on the kerbside with handles facing the property on collection day. 
  • Excess garbage must be removed from premises or taken to a local waste facility upon departure. 

Additional Cleaning Fees: 

  • If excess garbage is left on the property, additional cleaning and garbage fees will be charged to your credit card. 

17. Security & Break-Ins 

Guest Responsibility: 

  • Guests must secure the property (e.g., lock all doors and windows). 
  • Guests will be held liable for theft or damage caused by neglecting to secure the property. 

18. Discounts 

No Compensation Policy: 

  • Minor faults or appliance malfunctions do not entitle guests to compensation or discounts. 

19. Moving Bookings to Another Property 

Relocation Rights: 

  • In cases of storm damage, service failures, or other uncontrollable events, McGrath Coffs Coast Escapes reserves the right to relocate guests to alternate accommodationssubject to availability. 

Notification & Refunds: 

  • Guests will be notified as soon as possible. If no alternative accommodation is found, full refund (less a 3% merchant fee) will be issued. 

20. Indemnity 

Liability Waiver: 

  • McGrath Coffs Coast Escapes and property owners are not liable for injury, loss, or inconvenience beyond their control. 
  • Guests are advised to take out personal or travel insurance. 

Indemnification: 

  • Guests agree to indemnify McGrath Coffs Coast Escapes and property owners against any claims, fines, legal costs, or damages arising from their stay unless directly caused by the property owners or McGrath Coffs Coast Escapes. 

21. Damage & Breakages 

Guest Responsibility for Damages: 

  • Guests are liable for accidental breakages, damage, excess garbage, or missing items. 

Furniture & Item Handling: 

  • Moving furniture or removing items between units is prohibited. Any unreturned or misplaced items will be charged as replacements. 

Fees: 

  • Additional fees may apply if furniture is moved, and any missing inventory items will be charged to the guest. 
  • These terms ensure the smooth operation and maintenance of the properties while setting clear expectations for both guests and management. 

22. Liability 

Website Use: 

  • McGrath Coffs Coast Escapes is not liable for any losses or damages caused by the use of this website or any linked websites, to the extent permitted by law. 

Right to Refuse Bookings: 

  • McGrath Coffs Coast Escapes reserves the right to refuse any booking without explanation. 

Booking Cancellation & Refunds: 

  • If a booking is cancelled, reasonable efforts will be made to contact you using the provided contact details. 

Refunds: 

  • All payments received will be refunded using the original payment method, subject to these Terms and Conditions. 
  • This clause ensures transparency regarding management and limits liability associated with website use or transactions. 

23. Lost Keys 

If property keys are lost, the Guest is responsible for: 

  • Changing the locks. 
  • Cutting 4 new sets of keys. 

The replacement cost of any lost remotes, tags, or fobs will also be charged to the Guest. 

The keys are your responsibility, so please take care of them. 

24. Lock Outs 

During office hours: 

  • Guests can contact McGrath Coffs Coast Escapes for spare keys at no cost. 

After hours: 

  • A fee of $110 will be applied to the Guest prior to the provision of spare keys. 

Broken lock (during or after office hours): 

  • A locksmith will be engaged, and the Guest will bear all costs. 

25. Lost Property 

  • McGrath Coffs Coast Escapes will attempt to recover and return any lost items, though no responsibility is taken for their recovery or return. 
  • The Guest must provide McGrath Coffs Coast Escapes with a pre-paid return package to enable the return of lost items.  
  • Items found by cleaners will be held for two weeks, after which they will be disposed of if unclaimed. 

26. Unnecessary Call Outs 

  • If a requested repair is deemed unnecessary, the Guest will be charged for the call-out. 
  • Common issues include misuse of televisions, ovens, or washing machines. 

27. Sale of the Property 

  • If the Property is sold before your stay begins: 
  • Your booking may remain unaffected if the new owner continues to rent the Property. 
  • If the new owner decides not to rent the Property, you will be notified as soon as possible. 
  • McGrath Coffs Coast Escapes will attempt to find alternative accommodation, but it is not guaranteed. 
  • If you choose to cancel, you will receive a full refund (less 3% bank merchant fee). 

 28. Third-Party Websites 

  • If you booked through a third-party website, the terms and conditions of that booking channel will take precedence over McGrath Coffs Coast Escapes’ terms. 
  • It is your responsibility to review and comply with any third-party terms and conditions.
